WHEREAS, on July 10, 2007, Arthur C. Lofton, Sr. and Rebecca A. Lofton executed a certain deed of trust to Investors Title Insurance Company, Trustee for the benefit of Mortgage Electronic Registration Systems, Inc. as beneficiary, as nominee for IndyMac Bank, F.S.B., its successors and assigns which deed of trust is of record in the office of the Chancery Clerk of Warren County, State of Mississippi in Book 1675 at Page 178 Instrument No. 250705 and re-recorded in Book 1709 at Page 257 Instrument No. 286883 and re-recorded in Book 1711 at Page 89 Instrument No. 292080; and
WHEREAS, LLG MS LLC has heretofore been substituted as Trustee by instrument dated June 7, 2023 and recorded in the aforesaid Chancery Clerk’s Office in Book 1692 Page 199; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, U.S. BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE FOR RCF2 ACQUISITION TRUST, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney’s fees, trustee’s fees and expense of sale.
NOW, THEREFORE, I, LLG MS LLC, Substituted Trustee in said deed of trust, will on October 6, 2023 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the West Door of the County Courthouse of Warren County, located at 1009 Cherry Street, Vicksburg, MS 39180, to the highest and best bidder for cash or certified funds the following described property situated in Warren County, State of Mississippi, to-wit:
Parcel One Part, Section 10, Township 14 North, Range 3 East, Warren County, Mississippi, more particularly described as follows: To get to the point of beginning, commence at the point where the present (1971) east right-of-way line of U.S. Highway 61 intersects the east-west centerline of Section 10, and run thence North 84 degrees 17 minutes East 2,225.0 feet; thence North 78 degrees 25 minutes East, 307.0 feet; thence South 84 degrees 22 minutes East, 150.0 feet to the point of beginning; thence North 05 degrees 00 minutes West, 413.0 feet to a fence line; thence South 77 degrees 15 minutes East, 260.0 feet; thence South 13 degrees 00 minutes West 440.0 feet; thence North 50 degrees 20 minutes West, 46.0 feet; thence North 63 degrees 39 minutes West 71.0 feet; thence North 81 degrees 53 minutes West, 93.0 feet to the point of beginning, containing 2.2 acres, and being the same property conveyed to Albert Edward Tait, Jr. and Joyce Lorraine F. Tait by Tom Kirkland and Myrtle C. Kirkland by correction deed dated June, 1971 and recorded in Deed Book 476 at Page 470 of the Warren County, Mississippi Land Records. Parcel Two Part of Section 10, Township 14 North, Range 3 East, Warren County, Mississippi, more particularly described as follows, to-wit: Commence at an iron pin in the centerline of a bayou and the centerline of Section 10, Township 14 North, Range 3 East, Warren County, Mississippi and run thence South 81 degrees 45 minutes 00 seconds East along the centerline of Section 10 3502.73 feet to an iron pipe; thence from said iron pipe North 56 degrees 47 minutes 46 seconds West 1562.25 feet to an iron pipe on the South edge of a public gravel road being the Northeast corner of the property herein described; run thence South 33 degrees 21 minutes 23 seconds West 625.63 feet; thence North 81 degrees 41 minutes 56 seconds West 133.02 feet; thence North 10 degrees 22 minutes East 400.0 feet; thence North 29 degrees 00 minutes West 188.0 feet to the Southedge of the aforementioned gravel road; thence along said South edge North 87 degrees 23 minutes 31 seconds East 240.44 feet; thence South 76 degrees 33 minutes 12 seconds East 262.88 feet to the point of beginning, containing 3.70 acres.
I WILL CONVEY only such title as vested in me as Substituted Trustee.
