WHEREAS, on the 18th day of March, 2008, Frannie Gary a single woman, executed and delivered a certain Deed of Trust unto Joan H Anderson, Trustee for Mortgage Electronic Registration Systems, Inc. as nominee for The Mortgage Lending Group Inc, Beneficiary, to secure an indebtedness therein described, which Deed of Trust is recorded in the office of the Chancery Clerk of Warren County, Mississippi in Book 1699 at Page 564 Instrument# 263639; and
WHEREAS, on the 7th day of October, 2009, the Holder of said Deed of Trust filed a Loan Modification Agreement of Deed of Trust by instrument recorded in the office of the aforesaid Chancery Clerk of Court in Book 1502 at Page 28 Instrument# 273134; and
WHEREAS, by various assignments on record said Deed of Trust was ultimately assigned to U.S. Bank National Association, not in its individual capacity but solely as trustee for the RMAC Trust, Series 2016-CTT by instrument recorded in the office of the aforesaid Chancery Clerk in Book 1652 at Page 787 Instrument# 380130; and
WHEREAS, on the 24th day of February, 2022 the Holder of said Deed of Trust substituted and appointed Dean Morris, LLC as Substitute Trustee by instrument recorded in the office of the aforesaid Chancery Clerk in Book 1674 at Page 220 Instrument# 391441; and
WHEREAS, default having been made in the payments of the indebtedness secured by the said Deed of Trust, and the holder of said Deed of Trust, having requested the undersigned so to do, on the 14th day of April, 2023, I will during the lawful hours of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale and will sell, at the west front door of the Warren County Courthouse at Vicksburg, Mississippi, for cash to the highest bidder, the following described land and property situated in Warren County, Mississippi, to-wit:
Commencing at a found iron marking the Northeast corner of the Freddie Nichols tract, per Deed Book 538 at Page 457 of the land Records of Warren County, Mississippi; thence, S 56 degrees 00’00”W, a distance of 206.30’ to a set iron and the Point of Beginning; thence, S 22 degrees 44’03”E a distance of 63.41’ to a set iron; thence, S 29 degrees 32’26”W a distance of 149.83’ to a set iron in the Eastern right of way of Old Gibson Road; thence, Northwesterly, along said right of way, N43 degrees 00’00W a distance of 71.49’ to a set iron, thence, continue N 20 degrees 03’00W” a distance of 60.00’ to a found 1/2” iron; thence, leaving said road N 56 degrees 00’00”E a distance of 143.70’ to the Point of Beginning, containing 0.32 acres, more or less, said property located in the Southeast corner of the Southeast Quarter of the Northwest Quarter of Section 8, Township 15 North, Range 4 East, Warren County, Mississippi.
