PUBLIC NOTICE

SUBSTITUTED TRUSTEE’S NOTICE OF SALE

WHEREAS, on October 31, 2013, Dennis J. Fowler, a single man executed a certain deed of trust to T. Harris Collier, III, Trustee for the benefit of Mortgage Electronic Registration Systems, Inc. as beneficiary, as nominee for Trustmark National Bank, its successors and assigns which deed of trust is of record in the office of the Chancery Clerk of Warren County, State of Mississippi in Book 1719 at Page 97 Instrument No. 313352; and
WHEREAS, J.P. Morgan Mortgage Acquisition Corp. has heretofore substituted LLG MS LLC as Trustee by instrument dated August 19, 2021 and recorded in the aforesaid Chancery Clerk’s Office in Book 1668 at Page 47 Instrument No. 387857; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, J.P. Morgan Mortgage Acquisition Corp., the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney’s fees, trustee’s fees and expense of sale.
NOW, THEREFORE, I, LLG MS LLC, Substituted Trustee in said deed of trust, will on February 11, 2022 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the West Door of the County Courthouse of Warren County, located at 1009 Cherry Street, Vicksburg, MS 39180, to the highest and best bidder for cash or certified funds the following described property situated in Warren County, State of Mississippi, to-wit:
That certain lot, tract or parcel of land lying and being situated in the County of Warren, State of Mississippi, being all of Lot Number Eleven (11) of the Sky Heights Subdivision Extension, a plat of which is recorded in Book 116, Page 169 of the Land Records in the office of the Clerk of the Chancery Court of said County.
AND part of Lot 12 of the said Sky Heights Subdivision Extension, described as follows, to-wit: Begin at an iron pipe located on Sky Farm Avenue, which pipe marks a corner common to Lots 11 and 12 of the Sky Heights Extension Sub-division, a plat of which sub-division is duly recorded in Book 116 at Page 169 of the Land Deed Records in the office of the Clerk of the Chancery Court of. Warren County, Mississippi; run thence South 61°35’ East a distance of 367 feet to a point on Leatrice Lane; run thence South 47°11’ West 118.1 feet to a point which marks a corner common to Lots 11 and 12 aforesaid; run thence North 42°49’ West along the boundary tine of Lots 11 and 12 a distance of 347.5 feet to the point of beginning of the parcel hereby conveyed, it being the intention to convey a triangular strip in Lot 12 of said sub-division.
LESS AND EXCEPT: Begin at an iron pipe on Sky Farm Avenue, which pipe marks a corner which is common to tots 10 and 11 of Sky Heights Extension Sub-Division, a plat of which sub-division is duly recorded in Book 116 at Page 169 of the Land Deed Records in the office of the Clerk of the Chancery Court of Warren County, Mississippi; and run thence South 68°28’ East a distance of 273 feet to a point on Leatrice Lane; run thence South 47°11’West 118.1 feet to a point which marks a corner common to Lots 10 and 11 of said subdivision; run thence North 42°49’ West along the line dividing Lots 10 and 11 of the aforesaid a distance of 246 feet to the point of beginning of the parcel hereby conveyed; said land comprising a triangular strip’ of land located in Lot 11 of said sub-division,
I WILL CONVEY only such title as vested in me as Substituted Trustee.
